The court presumes a defendant innocent until proven guilty beyond any reasonable doubt. Upon conviction, a defendant can face a penalty of up to five years in federal prison for a gambling crime. The court is bound to follow the US sentencing guidelines and federal statuses in terms of imposing a reasonable sentence upon the conviction of a defendant.
